Terms of Service for RSVPTree

Effective Date: April 16, 2026

1. Acceptance of Terms

By accessing or using RSVPTree.app ("the Service"), operated by Caleb Dorris ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

RSVPTree provides a platform for users ("Hosts") to create digital invitations and manage guest communications via email and SMS.

3. User Responsibilities & Guest Consent

As a Host, you are solely responsible for the content you upload and the contacts you invite.

  • Consent Warranty: You represent and warrant that you have obtained prior express consent from every guest whose contact information you upload to RSVPTree to receive event-related communications.
  • Compliance: You agree to use the Service in compliance with the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act.
  • Indemnification: You agree to indemnify and hold harmless Caleb Dorris/RSVPTree from any legal claims, fines, or damages resulting from your failure to obtain proper guest consent.

4. Messaging Rules (SMS & Email)

  • Frequency: The number of messages sent will vary based on the event settings chosen by the Host.
  • Opt-Out: All guests have the right to opt-out of communications. You may not attempt to bypass our "STOP" keyword functionality.
  • Prohibited Content: You may not use RSVPTree to send "SHAFT" content (Sex, Hate, Alcohol, Firearms, Tobacco) or any illegal, harassing, or deceptive messages.

5. Fees and Payments

RSVPTree may offer free and paid tiers. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' notice.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RSVPTREE AND CALEB DORRIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU TO US IN THE LAST 12 MONTHS.

7. Termination

We reserve the right to suspend or terminate your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

8. Governing Law

These Terms are governed by the laws of the State of Tennessee. Any disputes shall be resolved in the courts of Davidson County or Sumner County, TN.
